Правила використання 3D моделей

§1 Definitions

  1. Regulations – regulations of using 3D models of 27 July 2018;
  2. 3D model – three-dimensional object saved in electronic form being a furniture accessory, in particular such as a handle, hinge, slide, drawer system, light source, lighting fixture or other electrical accessory (in particular an extension cord, switch, control element or power supply), made available in the Service;
  3. The Service – website available at the address www.gtv.com.pl, offering 3D models downloading;
  4. GTV – company GTV Poland spółka akcyjna (formerly: GTV Poland spółka z ograniczoną odpowiedzialnością spółka komandytowa) with its location in Pruszków, entered in the register of Entrepreneurs of the National Court Register kept by the District Court for the capital city of Warsaw in Warsaw, XIV Commercial Division of the National Court Register under number KRS 0000938133, tax identification number: 5342505912;
  5. GTV AM – company GTV Asset Management spółka z ograniczoną odpowiedzialnością with its location in Pruszków, entered in the register of Entrepreneurs of the National Court Register kept by the District Court for the capital city of Warsaw in Warsaw, XIV Commercial Division of the National Court Register under number KRS 0000271190, tax identification number: 5342345087;
  6. User – a person using the Service.

§2 Rules concerning usage of Service

  1. The Regulations define the rules for making 3D models available for Users by GTV and the rules of using them.
  2. By using the Service, the User declares that he has read the content of these Regulations and that he fully accepts it, and undertakes to comply with its provisions.
  3. GTV reserves the right to change the provisions of the applicable Regulations unilaterally. Amendments to these Regulations may be made by GTV at any time and shall enter into force as soon as they are available in Service. Using the Service by the User after the changes have been introduced means their full acceptance.
  4. 3D models are made available for Users after their registration, including name and surname (company), address, e-mail address.
  5. 3D models are made available free of charge.
  6. Each of the 3D models is a separate work within the meaning of the Act of 4 February 1994 on copyright and related rights.
  7. The property copyrights to 3D are vested in GTV AM from 27 July 2018.
  8. GTV is entitled to share 3D models in accordance with the Regulations.
  9. Upon 3D model downloading by User, GTV grants this User free of charge, unlimited temporarily and territorially, non-exclusive license for the given 3D model in the following fields of exploitation:
    I. in the scope of entering 3D model into the computer memory and storing copies of the 3D model in it;

    I. in the scope of entering 3D model into the computer memory and storing copies of the 3D model in it;
    II. in the scope of recording and reproduction (copying) the 3D model by any technique, including printed, electronic form, or on CD, DVD, BlueRay and other storage media, as well as the production and reproduction of products made on its basis;
    III. in the scope of recording and reproduction (copying) the 3D model by any technique, including printed, electronic form, or on CD, DVD, BlueRay and other storage media, as well as the production and reproduction of products made on its basis;
    IV. in the scope of making them available on posters, brochures, catalogues, billboards and other advertising and promotional materials only when 3D models are a component of the presented furniture article in the field of lighting or electrical accessories which they co-create.
  10. The User is forbidden from further presenting, displaying and sharing stand alone 3D models in a common way, i.e. in particular in the mass media, on billboards, leaflets, brochures. In particular, the User is forbidden from presenting, displaying and sharing stand alone 3D models in order to derive financial benefits from this title.
  11. The User is not entitled to any modification of 3D models.
  12. The user is not entitled to grant a sub-license.
  13. 3D models are illustrative material only. The actual dimensions of the objects which they reflect may differ from the dimensions of the shared 3D models.
  14. The User cannot use 3D models to present them as products of other brands than GTV.
  15. GTV does not bear any responsibility for any damage resulting from the use of 3D model by Users.
  16. In the event of breaking the provisions of point II. 8 – 12 of the Regulations by User, all licenses granted based on the Regulations expire against this User with immediate effect.
  17. These Regulations shall be effective upon its publication in the Service.
